MaxSam Recovery Services provides excess funds recovery support and real estate services in the State of Texas. We assist property owners, heirs, and authorized representatives in reviewing potential surplus funds from tax sales, foreclosure proceedings, and other government-held excess fund events under Texas Tax Code §34.04. We also facilitate wholesale real estate transactions for qualifying properties when appropriate.
Program Name: MaxSam Recovery Services SMS Program
Program Description: Recipients of this SMS program may receive claim status updates, document requests, appointment reminders, agreement signing links, deadline reminders, follow-up messages, and customer support communications.
Consent to SMS is not required to use our services or submit a claim request. SMS messages are sent only to individuals who have provided express consent through one of the following voluntary methods:

MaxSam Recovery Services will not ask for credit card or payment information by SMS.
Carriers are not liable for any delayed or undelivered messages. Supported carriers include AT&T, T-Mobile, Verizon Wireless, Sprint, Boost, Cricket, MetroPCS, U.S. Cellular, and most other major U.S. carriers.
Mobile opt-in data and SMS consent information will not be shared, sold, rented, or transferred to any third parties or affiliates for marketing or promotional purposes.
There are no upfront fees or out-of-pocket costs to use MaxSam Recovery Services. Our service fee is disclosed in the signed agreement and applies only if recovery is successful. You only pay if funds are successfully recovered on your behalf. The specific fee percentage is disclosed in and governed by your individual client agreement prior to signing.
All service agreements are executed electronically in compliance with the Uniform Electronic Transactions Act (UETA) and the federal ESIGN Act. By signing an agreement electronically, you acknowledge that your electronic signature carries the same legal weight as a handwritten signature. You will receive a copy of any signed agreement via email or text message.
Recovery is not guaranteed. While we make every reasonable effort to assist with potential excess funds claims on your behalf, MaxSam Recovery Services does not guarantee that any specific amount will be recovered. Eligibility, filing deadlines, county requirements, court review, fund availability, and other factors outside our control may affect the outcome. Under Texas Tax Code §34.04, claims must be filed within two years of the tax sale date.

MaxSam Recovery Services is not a law firm and does not provide legal advice. We provide claim-research, document-preparation support, and recovery-assistance services. Customers may consult an attorney before signing any agreement.
Any disputes arising from or relating to these Terms of Service or any agreement with MaxSam Recovery Services shall first be addressed through good-faith negotiation. If a resolution cannot be reached, disputes shall be resolved through binding arbitration in the State of Texas, in accordance with the rules of the American Arbitration Association.
To the maximum extent permitted by applicable law, MaxSam Recovery Services shall not be liable for any indirect, incidental, special, consequential, or punitive damages. Our total liability shall not exceed the fees actually collected under the applicable agreement.
These Terms of Service shall be governed by the laws of the State of Texas. Any legal proceedings shall be conducted in the courts of the State of Texas.
